Parliamentary Ombudsman rules Supreme Court Secretary General: Gunnar Bergby's 10 September 'admin decision' re: Review of Breivik Judgement; is an Official Court Judgement

On 27 August 2012, I filed an Application (PDF) to Norway Supreme Court for Review of Oslo District Court: Breivik Judgement Ruling; to Set Aside the Judgements (1) ‘Necessity (Nodrett) Ruling’ and (2) Defendant’s Conviction (Finding of Guilt) and Remit to Oslo District Court for hearing of Further Evidence to conclude Objective and Subjective Necessity Test Evidentiary Enquiry.

The Supreme Court Registrar refused to respond to my application, so i filed a complaint of Slow Processing (PDF) to the Parliamentary Ombudsman on 02 September 2012. On 10 September 2012, Supreme Court Secretary General: Gunnar Bergby responded - (Application for review of Oslo District Court Judgement of 24 August 2012 (2011-188627-24). He implied my application was an 'appeal', and that I lacked legal standing (locus standi), because only the 'parties to the case' can appeal.

On 11 September 2012, I responded (PDF) that my application was not an appeal, but a Review, and furthermore, that matters of locus standi are investigated by courts, after hearing evidence on the matter, not by Registrars. I requested him to provide me with a statute that granted him the authority to make a ruling on legal standing (locus standi); thereby denyiing me access to the court.

On 08 October 2012, I sent a reminder request to Sec. Gen. Bergby, but received no response. On 03 November I filed another complaint to the Parliamentary Ombudsman: Complaint of Supreme Crt Registrar Slow Case Processing (PDF), requesting the Parliamentary Ombudsman order Sec. Gen. Bergby to either (a) provide me with the relevant statute granting him the authority to make a ruling on legal standing, or (b) process my application for review of the Breivik judgement.

On 15 November, the Parliamentary Ombudsman ruled that Sec. Gen. Bergby's 'administrative decision' was not an 'administrative decision', but a 'Decision (Judgement) by a court of law'; and that the Parliamentary Ombudsman has no authority to investigate 'decisions by a court of law', only administrative decisions of slow case processing.

So, the Parliamentary Ombudsman is saying that if you file an application with a court, and the registrar makes some administrative decision about your application, that is a 'judgement by a court of law'. Very strange, cause 'judgements/decisions by a court of law', only occur after a court has heard all the relevant evidence in the matter, from all parties.

So, it appears that the Parliamentary Ombudsman is not willing to rock the boat, and do their job by ordering the Supreme Court Secretary General, to either provide the relevant statute granting him the authority to make a decision on locus standi, or to process my application.

This means however, that an Application can be filed with the European Court of Human Rights, since the highest Norwegian court (Supreme Court) has issued a judgement (without general due process procedures), on my Application for Review.

In the article: The Deliberations in the Breivik Case are Null and Void, published on 02 July 2012, Editor: Herman Berge argues that the Breivik court case was invalid, due to illegal and irregular appointment of the Judges in the case; who were specifically 'picked out'; instead of the required coincidence principle.

Simply put he writes that Judge Geir Engebretsen committed a coup d'etat of the Oslo District Court, without a single lawyer or journalist objecting in protest at the irregularities. Amazing. Furthermore Breivik's case must be retried, with new judges appointed in the proper legally required procedure.

Finally Judge Engrebertsen's procedure of deliberately choosing Breivik's Judges without any objections from political leaders, lawyers or the media confirms a Judicial court system in moral decay.

Mathias Eckhoff (21): was at the Great Hall information meeting, when heard shots; he ran to hide at the Pump House, where he was shot in the thigh. He went down to the water and managed to be picked up by a boat.

Mohamad Hadi Hamed (21): is originally from Iraq and came to court in a wheelchair. He was at the Great Hall information meeting, and then ran to the pump house, where he pretended to be dead, but was shot three times, once in the arm, once in the side, and was finally rescued by a boat. His leg and arm had to be amputated.

Einar Bardal (17): was in the dining room when people arrived screaming, they jumped out the window and ran to the western part of the island, where he was shot in the face while hiding. He had 150 metal fragments in his face, and many in his knee.

Cecilie Herlovsen (17): was in the Great Hall when she heard the bangs, she ran to the Pump House; where she was shot in the knee and wrist and shoulder. Her arm had to be amputated at the elbow.

Ingela Heie (18): was at the information meeting, when the panic erupted; she ran with others to the Pump House, where she decided to try and swim, but then went to the S.Tip, where she was shot in the arm and head.

Ylva Helene Schwenke (15): was at the Oslo bomb information meeting when she heard shots, ran past Love Trail, crept up the slippery cliff, where she was shot in the chest and shoulder. Managed to get down to the water, where she was shot in both legs.

Anon Male (18): was in Utoya with his little brother of 14 years, they were at the Oslo bomb information meeting when they heard the shots, and ran down to the Love Trail. He was shot in the head while trying to get in the water, kept himself awake by talking to himself. He had very serious injuries, both thighs, hands, forearm, shoulder and head, and is blind in one eye.

Eirin Kristin Kjær (20): was at the information meeting when heard the shots, ran to the woods, to the cliff where she hid under a ledge, but was shot in the stomach. Later she was again shot in the arm and foot. she was shot four times: stomach, arm, leg, and both arms.

Espen Myklebust (18): heard there was armed police on the way to the island, saw Breivik shoot someone at the Cafebuilding and then ran like hell south, past Love Trail to the water, where he was picked up by a boat.

Anon Female: was in her tent eating candy when she was told to go to Oslo bomb information meeting; heard shots and ran past Love Trail to Pump House and was shot in the back and arm.

Hussein Kazemi (20): came from Afghanistan to Norway in 2009; heard about AUF through a friend. Arrived late the night before so was sleeping in his tent when he was told to go to Oslo bomb information meeting. Did not understand the fuss, cause 'this happens every day in Afghanistan'; was shot a few times, while running and swimming away.

Hanne Hestø Ness (20): was in the Great Hall for information about the Oslo bomb, and was shot a few times in the arms and neck, felt paralyzed.

Marte Fevang Smith (18): was at the outdoor stage to find information about the Oslo bomb; she ran to Love Trail where she was shot, and finally hid in a tent.

Marte Gustavsen Ødegården (18): was at the Buskerud AUF camp toilet when she saw people running. She ran to the Love Trail with others. She was shot twice in the lower back, and dragged herself down to the water where she lay for an hour. She hovered between life and death for several days.

Renate Tårnes: was in the Cafebuilding for Oslo bomb meeting; heard the shots and watched Snorre go down to the mainhouse where he confronted Breivik and was shot. She ran back to Cafebuilding and hid in the Little House.

Ingvild Leren Stensrud (17): was on the way to the information building when she heard the first shot and found people running up the hill. Even Andre Øien Kleppen (32): works for Norwegian People's Aid who work at the Utoya camps providing aid or transportation in the event of accidents. He heard about Oslo bomb and went to catch the same ferry to Utoya that Breivik was on. He helped to barricade Skolestua with others.

Anon (18): was in a tent with a friend when they heard shots, and thought it was a joke. Then they saw people running up the hill. He ran along the Love Path and along with others decided to swim. He managed to swim accross to mainland.

Julie Størholt Iversen (17): was sitting in a tent chatting to friends about Oslo bomb, when they heard shots. Iversen was shot in the left leg while escaping.
